CHERRY HILL, NJ, May 09, 2012 /24-7PressRelease/ -- If you are a pedestrian who is the victim of a car accident - having been struck by an automobile or other motor vehicle - who is legally responsible to pay PIP benefits? As a general rule, PIP pays medical bills, lost wages, essential services, and death benefits.
These are three basic rules:
1. If pedestrian is struck by an automobile and the pedestrian owns a personal auto or resides with a family member who does, then the PIP is paid by the personal or family policy.
2. If the pedestrian is struck by an automobile and the pedestrian does not own a personal auto and does reside with a family member who owns an automobile, then the PIP is paid by PLIGA. (A state insurance fund)
3. If the pedestrian is struck any non-automobile (INCLUDING A MOTORCYCLE or motorized bicycle) then the PIP is paid by the insurance company for the striking vehicle--even if the pedestrian owns a car with a family member who owns a car.
PIP laws vary from state to state and these apply to New Jersey PIP Benefits. PIP benefits are initially enclosed as part of no fault auto insurance.
