The firm is representing several victims who were on vacation from India.

On July 17, 2011, the tour bus traveling from Washington D.C. to Niagara Falls crashed in upstate New York, about 60 miles south from Rochester, according to USA Today. Officials believe that the bus was traveling about 72 mph when one of the front tires blew out, causing the driver to lose control. The bus veered off the Interstate 390 and down an incline into a wooded area before it tipped over. Two bus passengers died in the crash and several others were severely injured.

According to papers filed in a Niagara County court, the personal injury lawsuit (index # 146963/2012) names tire manufacturer Bridgestone, tour bus company Bedore Tours, the driver of the bus and bus manufacturer Motor Coach Industries.

The material regulation involved required a seatbelt for the bus operator, but was silent regarding restraints for the passengers. The jury in the case found that seat belts should have been provided for the passengers.

In the tour bus crash case just filed, a seatbelt was provided for the tour bus driver, but not for the passengers. Given that the bus driver had his seatbelt on and was not injured, it is likely that many of the passengers would similarly have avoided harm with safety restraints as well.
