May 12, 2012 /24-7PressRelease / -Florida Senate Bill 1810 proposed sweeping changes to the Florida laws governing driving under the influence of alcohol or drugs. There are a few obvious changes that would have an immediate effect; for example, the new Act would have classified the offence as "driving while intoxicated", instead of "driving under the influence." This may seem like a simple semantic argument since most people assume DUI and DWI are interchangeable terms, - and that may be true in some jurisdictions - but in legal language, the new and old Act were as different as night and day.

The Bill would have greatly increased the scope representatives of the law regarding driving under the influence which impaired by alcohol, drugs or "other substances reached". The Bill did not define specifically how Parliament would define "other substances interfere", but some legal industry experts have speculated that the provision was deliberately vague so scan tests could be performed for even the slightest trace of drugs (drug "metabolites") or alcohol in the system drive.

The Act would always remain in failure by the Lac 08 for those accused of driving under the influence of alcohol, but fact no progress by offering explicit guidelines to the police and prosecutors who seek some clarity on when a drug prescription or drug is sufficient volume to be "impaired" driver. Current Florida law is not clear on this subject is, and the majority of so-called "drugs driving" cases is decided on a factual basis, one by one.

Chance for drivers of Florida, SB 1810 died in Committee earlier this year, but it is quite possible that similar provisions may be transmitted in future legislative sessions. Even if the law does not change now, a Florida DUI charge is always a serious matter.
