Proposed changes to the laws on Domestic Violence in New York

Allegations of abuse can lead to criminal charges and may also affect the decisions of courts of the family. An important part of the understanding of its rights is whether how crimes are defined in New York. Recently, the legislators of proposed state of changes to the laws on violence in New York which would be more stringent laws.

Legislators of State of New York recently proposed amendments to the statutes of the violence of the State that would make it a felony to commit several offences of domestic violence. Under the current laws of the violence of the State, persons who would commit domestic violence and cause no serious injuries or death may only be charged with a crime. An individual charged with a general offence faces a sentence lighter than someone accused of a crime. The proposed amendment to the Act on domestic violence in New York would create a crime of felony-level of violence increased for persons convicted of offences of domestic violence two or more within five years.

Under the current system, individuals who are recognized convicted of several offences of domestic violence are treated in the same way regardless of whether conviction was for an offence or a criminal offence. Supporters of the Bill say that the change would allow greater assistance to victims and the families, because the felony protection orders are issued for a period longer than the tort protection orders.

Containing the amendments to the proposed law the violence of the legislation adopted at the Assembly of New York State, but a vote on the legislation to the Senate of the State has been postponed.

There are also other recent proposals to the laws on violence in New York. Some of these changes are the following:
-a measure to prohibit discrimination in housing against victims of family violence
-a draft law which would prohibit discrimination against victims of violence in the workplace
-a proposal that would require hospitals to provide effective assistance to the victims of domestic violence

Other recently proposed changes would also affect those convicted of domestic violence. The measure would prohibit people who have a restraining order against them to obtain a firearms licence or have in his possession a firearm. Recognized individuals convicted of violence would be also prohibited to buy weapons to fire. The current federal law prohibits anyone who has a final protective order issued against them to fire a weapon.
